Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  1. Cooling-off period: the period during which the consumer may exercise the right of withdrawal.

  2. Consumer: a natural person who does not act in the course of a profession or business and enters into a distance contract with the entrepreneur.

  3. Day: calendar day.

  4. Continuous transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.

  5. Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.

  6. Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period.

  7. Model withdrawal form: the withdrawal form provided by the entrepreneur that a consumer can use to exercise the right of withdrawal.

  8. Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.

  9. Distance contract: a contract concluded within the framework of an organized system for distance selling, using one or more means of distance communication.

  10. Means of distance communication: any means that can be used to conclude a contract without the consumer and entrepreneur being physically present together.

  11. Terms & Conditions: these present Terms & Conditions.

Article 3 – Applicability

  1. These Terms & Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between entrepreneur and consumer.

  2. Prior to concluding a distance contract, the text of these Terms & Conditions will be made available to the consumer.

  3. If the contract is concluded electronically, the Terms & Conditions may be provided electronically in a way that allows them to be stored on a durable data carrier.

  4. If specific product or service conditions also apply, the consumer may rely on the provision most favorable to them in case of conflict.

  5. If any provision is invalid or void, the remaining provisions shall remain in force.

  6. Situations not regulated in these Terms & Conditions shall be assessed in accordance with the spirit of these Terms & Conditions.

  7. Ambiguities regarding interpretation shall be explained in accordance with the spirit of these Terms & Conditions.

Article 4 – The Offer

  1. If an offer has a limited validity period or conditions, this will be clearly stated.

  2. All offers are non-binding.

  3. The offer contains a complete and accurate description of the products and/or services offered.

  4. Images and specifications are indicative and cannot give rise to compensation or termination.

  5. Product images represent the products truthfully; color deviations may occur.

  6. Each offer clearly states the rights and obligations attached to acceptance, including price, shipping costs, payment, delivery, right of withdrawal, and contract duration.

Article 5 – The Agreement

  1. The agreement is concluded at the moment the consumer accepts the offer and meets the conditions.

  2. Electronic acceptance is confirmed by the entrepreneur via email.

  3. The entrepreneur ensures appropriate security measures for electronic transactions.

  4. The entrepreneur may refuse an order or impose conditions if justified.

  5. The entrepreneur provides written confirmation including address, withdrawal conditions, warranties, and cancellation requirements.

  6. For continuous transactions, this applies only to the first delivery.

  7. Agreements are subject to product availability.

Article 6 – Right of Withdrawal

Products

  1. Consumers may withdraw within 14 days without giving a reason.

  2. Products must be handled carefully and returned in original condition where possible.

  3. The consumer must notify withdrawal within 14 days and return the product within 14 days.

  4. Failure to do so finalizes the purchase.

Services

  1. Consumers may withdraw within at least 14 days after concluding the agreement.

  2. Withdrawal must follow the entrepreneur’s instructions.

Article 7 – Costs in Case of Withdrawal

  1. Return shipping costs are borne by the consumer.

  2. Refunds are processed within 14 days after receiving the return.

  3. The consumer is liable for depreciation caused by improper handling.

  4. No liability applies if mandatory withdrawal information was not provided.

Article 8 – Exclusion of the Right of Withdrawal

  1. The right of withdrawal may be excluded if clearly stated.

  2. Exclusions apply to custom-made, personal, perishable, sealed hygiene products, and opened media/software.

  3. Exclusions also apply to certain services (e.g., accommodation, transport, leisure activities).

Article 9 – The Price

  1. Prices remain unchanged during the validity period, except for VAT changes.

  2. Variable pricing may apply for market-dependent products.

  3. Price increases within 3 months are only allowed if legally required.

  4. Prices include VAT.

  5. Typographical errors are not binding.

Article 10 – Conformity and Warranty

  1. Products comply with the agreement and legal requirements.

  2. Warranties do not affect statutory consumer rights.

  3. Defects must be reported within 2 months.

  4. Warranty equals manufacturer warranty.

  5. Warranty does not apply to misuse or unauthorized repairs.

Article 11 – Delivery and Performance

  1. Orders are handled with due care.

  2. Delivery occurs at the address provided by the consumer.

  3. Orders are delivered within 30 days unless otherwise agreed.

  4. Delivery times are indicative.

  5. Refunds after cancellation are processed within 14 days.

  6. Replacement products may be offered.

  7. Risk transfers upon delivery.

Article 12 – Continuous Transactions

Termination

Consumers may cancel ongoing agreements with up to one month’s notice.

Renewal

Fixed-term agreements may not be automatically renewed unless legally permitted.

Duration

Agreements longer than one year may be canceled after one year with one month’s notice.

Article 13 – Payment

  1. Payments must be made within 7 business days unless agreed otherwise.

  2. Incorrect payment details must be reported immediately.

  3. Reasonable collection costs may apply in case of non-payment.

Article 14 – Complaints Procedure

  1. Complaints must be submitted within 2 months.

  2. Complaints are handled within 14 days.

  3. Consumers may also submit complaints via the EU ODR platform.

  4. A complaint does not suspend obligations.

  5. Valid complaints may result in replacement or repair.

Article 15 – Disputes

  1. Dutch law applies to all agreements.

  2. The Vienna Sales Convention does not apply.

Article 16 – Additional or Deviating Provisions

Any additional or deviating provisions must not disadvantage the consumer and must be recorded in writing or on a durable data carrier.
